Third party Quality Control review and warranty on projects insulated by certified contractors with WALLTITE® by BASF - The Chemical Company
WALLTITE is an effective insulation air barrier system listed under Canadian Construction Material Center (CCMC) 12840-R for insulation, CCMC 12877-R for air barrier material and CCMC 12932-R for air barrier system. In addition, it conforms to CAN / ULC-S705.1 and exceeds the requirements stated in section 5 of the 2005 National Building Code (NBC). BASF Canada Inc. trains contractors who use certified and approved applicators to install
WALLTITE. Only these highly trained, experienced and qualified applicators are approved to install the BASF insulation / air barrier system. Extensive training, along with third party quality control review, ensures quality installation of all engineered building envelope products. In the CCMC report, section 4. Usage and Limitations, it states the following: ''BASF Canada mandates, as part of their field quality control assurance and training program, that the WALLTITE spray foam insulation material shall be manufactured on-site by qualified installers licensed by BASF Canada with field review carried out by a third-party
Certification organization. The third-party certification organization certifies the BASF Canada training program and provides follow-up review of installers in the field for installations in accordance with CAN / ULC-S705.2-98, Standard for Thermal Insulation-Spray Applied Rigid Urethane Foam, Medium Density, Installer's Responsibilities-Specification (formerly CAN / CGSB-51.39-92. The third party certification organization specified by BASF Canada Inc. is Morrison Hershfield (MH) Limited. The installation procedure shall follow the manufacturer's installation instruction manual. A copy of this manual shall be available at the job site at all times during the installation. All installers shall present their BASF Canada licensing card and specific site work sheet upon request by the building official''.
1. Note: The BASF Canada field quality assurance program calls for periodic audits of the installers, usually random review with some mandatory review of larger projects. Building officials may contact BASF Canada (1-866-474-3538) and require a review for a specific jobsite if the building official deems it necessary. In cases where the installation is deemed non-conforming by MH/BASF Canada and is not being remedied by the installer, MH/BASF Canada will inform the owner/architect/building official of the non-conforming installation.
BASF confirms to the contractor/architect/building professional the following:
1. Our WALLTITE meets the Canadian Standard CAN/ULC-S705.1 and when applied according to the Canadian Standard CAN/ULC-S705.2 that the product will produce a product according to our specifications.
2. BASF will notify the Federal government about any modification on our existing CCMC products and will obtain approval from them before BASF sells the modified product in the field.
3. BASF will sell its CCMC products only to approved and certified contractors.
Morrison Hershfield, our third party service provider will receive from BASF a list of the approved certified contractors that are authorized to buy and apply our products. They will also be notified of any suspended contractors.
4. In Case of a failure by a contractor to follow our Quality and Training Program, Raising Performance To New Heights®, the contractor will be required to correct the situation immediately or will be suspended by BASF and Morrison Hershfield will be notified.
Warranty
Our WALLTITE CCMC approved spray system is covered by a warranty program:
Contractor Warranty
o The contractor will provide to the consumer a minimum of two-year warranty on the installed product.
Consumer Third Party Warranty
o Our warranty program for our WALLTITE CCMC approved material provides satisfaction to the consumer with a warranty up to $ 25,000.00 per project. More specifically, if the consumer is not satisfied and the contractor is unable, refuse to make the necessary correction(s) or if the contractor takes the position that the project is completed properly, a review process will start. Morrison Hershfield, an engineering firm will contact both the consumer and the contractor and will visit the project site. Morrison Hershfield will provide a report and determine whether the project was completed properly and in accordance with BASF's Quality Training Program, Raising Performance To New Heights®. If Morrison Hershfield determines that the contractor did not complete the job properly and in accordance with BASF's Quality Training Program, the contractor will be asked to correct the deficiencies in the project. If the contractor refuses or fails to do so, the contractor will be suspended from BASF's Quality Training Program and another contractor will be invited to make the necessary correction (s) up to a maximum amount of $ 25,000.00 per project, which will be paid by BASF.
Product Warranty
o BASF Canada Inc. ("BASF"), warrants for 2 years from the date of installation, that WALLTITE ("the Product"), if mixed according to BASF's published instructions before the Product's expiry date and if applied by certified contractors approved by our Quality Assurance Program, Raising Performance To New Heights® that the Product after its curing time, will not shrink or crumble or disintegrate under normal building wall conditions. Without limitation, this warranty specifically excludes failure of the Product due to:
o Natural causes such as lightning, earthquake, hurricane, tornado, fire, and acts of God; or
o Movement of the structure resulting in stresses on the cured foam plastic which exceed BASF's published elongation and / or compression for the Product, whether due to structural settlement, design or construction factors;
Or
o Disintegration of the underlaying substrate; or
o Mechanical damage to the cured foam plastic caused by individuals, tools, or any other outside agent or factors; or
o Application of any other substance not approved by the manufacturer to the surface of the cured foam plastic; or
o The method and procedure of installation and application or maintenance of the Product.
Other than BASF's obligation to provide the Product in compliance with BASF's published specifications and other than as stated herein, BASF makes no warranty or condition of any kind, either express or implied, by fact or law and BASF makes no warranty of fitness for a particular purpose or use, or warranty of merchantability. If within the warranty period specified above, the Product shrinks, crumbles or disintegrates and if it is conclusively proven that this is due solely to the Product's nonconformance with BASF's published specifications, BASF will replace the nonconforming Product at no charge. For greater certainty, BASF's liability and the user's/purchaser's exclusive remedy for any cause of action arising out of this warranty is expressly limited to the replacement of nonconforming Product at no charge. In no event shall, BASF be liable for any other damages, including indirect, incidental, special, economic or consequential damages.
